Charge: Robbery
Result: Case Dismissed
Juvenile client was charged with robbery for supposedly placing an ice-cream vendor in fear for his life and robbing him. Investigation by defense discovered that the ice-cream vendor was not in fear but was just mad and upset that one of the boys did not pay for an ice cream. Ice cream man acknowledged that he exaggerated when confronted with additional facts, and State dismissed the case.
Charge: Aggravated Assault on Peace Officer; Unlawful Carrying Weapon
Result: Felony Dismissed; Mental Health Probation
Client had a history of severe mental health problems. While in prison, he had been violently raped and brutalized so badly that he contracted numerous diseases and began a pattern of antagonizing prison guards solely to be placed in protective custody. In battling the pain of untreated mental health issues, client attempted to commit suicide by threatening a police officer in hopes of being shot. The officer who responded was nothing short of outstanding; he knew our client from the neighborhood and did an excellent job of calming him down. He assured the family that he would try to get the client help, and that he wasn’t going to charge him with anything more than a misdemeanor. The police Sergeant disagreed and pushed for our client to be indicted on the felony. Ultimately, we got in touch with the officer and coordinating a conference call with the DA. The felony was dismissed and our client was placed on a mental health caseload and received excellent care.
Charge: Driving While Intoxicated
Result: DWI dismissed
When the police pulled our client over, client was extremely upset because she had just been in a huge fight with her daughter. Unfortunately, she was somewhat belligerent with the cop because she had serious concerns about the stated reason he pulled her over. After reviewing the video, we agreed that she had reason to be upset: there was absolutely no basis for the patrol stop. We set the case for a motion to suppress because we felt the cop had pulled her over illegally. On the day of the pretrial hearing on the motion to suppress, the prosecutor agreed that it was an illegal detention and dismissed the case.
