Charge: Possession of a Controlled Substance, 2nd Degree Felony
Result: Felony dismissed; all evidence suppressed
Client was a passenger in a car that was pulled over for not having its headlights on. The driver of the vehicle was arrested for warrants and, afterwards, the officers began to interrogate our client. Ultimately, the officers searched our client and discovered a large amount of crack cocaine on his person. We challenged the legality of the extended detention on the basis that our client's constitutional rights were violated because of the manner in which he was seized and searched and we litigated the issue with the Judge. Ruling in our favor, the judge ruled that the officers had violated our client's constitutional rights and he suppressed all of the evidence.
Charge: Driving While Intoxicated (DWI)
Result: DWI charges not filed, case dismissed
Our client was pulled over for speeding and was asked to submit to the Field Sobriety Tests and the Breath Test after the officer suspected he was intoxicated. Our client, who was not intoxicated, knew that he had a fifth amendment right to not incriminate himself and he immediately invoked his right to a lawyer and refused all tests. Frustrated that our client refused the tests, the officer arrested our client for DWI. We helped our client get out of jail and we immediately had our client take a private blood test proving he had no alcohol or drugs in his system. We then made an immediate appointment with the prosecutor and were able to convince him to not file the charges.
Charge: Possession of Prohibited Weapon
Result: Dismissed outright
Katrina evacuee was charged with possessing brass knuckles after he called police to his house after his vehicle was burglarized. Based on argument of counsel, State dismissed case at first setting.
Charge: Possession of Marijuana
Result: Dismissed
Convinced prosecutor that client was a casual user and had stopped smoking marijuana by having client submit to urine analysis on several occasions.
